Overview
Welcome to Chorus. In these Terms of Service ("Terms"), "we", "us" and "our" refer to Baynhams Brewery Ltd, a company registered in England and Wales (company number 10602463) with registered office at Hops House, Brockenhurst, Hampshire SO42 7UF, trading as Chorus Beer. References to "Chorus" mean Baynhams Brewery Ltd in its capacity as the operator of chorusbeer.com.
These Terms govern your use of chorusbeer.com and any purchases you make through the site (the "Services"). The site is hosted on the Shopify platform, but all sales are made directly with Baynhams Brewery Ltd.
Please read these Terms carefully. They include important information about your legal rights, including the contract you form with us when you place an order, and the limited circumstances in which our liability is restricted. Nothing in these Terms affects your statutory rights as a consumer under UK law.
By using the Services, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy. If you do not agree, please do not use the site.
1. Age and eligibility
Chorus sells alcoholic beverages. By placing an order, you confirm that you are aged 18 or over and that any alcoholic products you purchase are for you or for a person aged 18 or over.
It is an offence under the Licensing Act 2003 to buy or attempt to buy alcohol on behalf of anyone under 18. We reserve the right to refuse or cancel any order where we have reason to believe the buyer is under 18 or is buying on behalf of someone under 18.
Sales are made under premises licence number 1752/1, issued by New Forest District Council.
You confirm that you have authority to enter into these Terms and to make purchases through the site.
2. Your account
You may shop on chorusbeer.com as a guest or by creating an account. If you create an account, you are responsible for keeping your login details confidential and for all activity that takes place under your account. You must provide accurate, current and complete information when registering and keep it up to date.
You may not transfer or sell your account to anyone else. We may suspend or close your account if we reasonably believe these Terms have been breached.
3. Our products
We have taken care to describe and display our products accurately. Colours and packaging may appear slightly different on your device depending on screen settings. Tasting notes are subjective.
Product descriptions, specifications, vintages and availability may change from time to time. We reserve the right to limit quantities, decline orders, or withdraw products at our discretion.
4. Orders and acceptance
When you place an order through the site, you are making an offer to buy. A contract is formed only when we send you an order confirmation email confirming that your order has been accepted and dispatched. Until then, we may decline your order for any reason, including stock availability, suspected fraud, or concerns about age verification.
If we decline or cancel your order, we will refund any payment taken in full.
Please check your order carefully before submitting. Once an order has been accepted and dispatched, it may not be possible to cancel or amend it; in that case, the Refund Policy applies.
5. Prices and payment
All prices shown on chorusbeer.com are in pounds sterling and include VAT at the prevailing rate where applicable. Delivery charges are shown separately at checkout.
The price you pay is the price displayed at the time you place your order, set out in your order confirmation email. We may change prices and promotions at any time without notice, but changes will not affect orders we have already accepted.
You confirm that the payment details you provide are valid, that you are authorised to use the payment method, and that funds are sufficient to cover the purchase.
Payments are processed via Shopify and its payment partners. We do not store full card details.
6. Delivery
We deliver in the UK via a Next Business Day Courier. Deliveries require a signature on arrival, and the carrier will refuse to release alcohol to anyone who appears to be under 18 or who cannot satisfy a request for proof of age. If no eligible recipient is available, the parcel will be returned and we will contact you to arrange redelivery, which may incur an additional charge.
Estimated delivery times shown at checkout are estimates only. We are not liable for delays caused by the carrier, weather, customs, strikes or other matters outside our reasonable control, but we will take reasonable steps to keep you informed and to resolve any issues.
In accordance with the Consumer Rights Act 2015, risk in the goods does not pass to you until they are delivered into your physical possession (or the possession of someone you have nominated to receive them). Until that point, goods lost or damaged in transit are our responsibility.
7. Refunds and returns
Your right to return goods, cancel orders, or claim a refund for damaged, faulty or wrong items is set out in our Refund Policy, which forms part of these Terms.
Nothing in these Terms or the Refund Policy affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
8. Intellectual property
The Chorus name, logo, packaging design, photography, copy, and all other content on chorusbeer.com are owned by Baynhams Brewery Ltd or used under licence. Our trade marks, including "Chorus", may not be used without our written permission.
You may view and print pages from the site for personal, non-commercial use. You must not reproduce, copy, modify, distribute, publish, or commercially exploit any content on the site without our prior written consent. All rights not expressly granted are reserved.
These rights are protected by the Copyright, Designs and Patents Act 1988, the Trade Marks Act 1994, and other applicable UK and international intellectual property laws.
9. Reviews and feedback
If you submit a review, comment, photograph or other feedback to us through the site or by email, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with the promotion of Chorus and Baynhams Brewery, with appropriate attribution where reasonable.
You confirm that anything you submit is your own original content, is accurate to the best of your knowledge, and does not infringe anyone else's rights.
We reserve the right to decline to publish, or to remove, any feedback we consider misleading, offensive, unlawful, or otherwise unsuitable.
10. Third-party links and tools
The site may link to or integrate with third-party sites and services (for example, payment processors, social media platforms, or delivery tracking). We are not responsible for the content, accuracy or availability of those third-party sites and services, and your use of them is at your own risk and subject to their own terms.
11. Acceptable use
You agree to use the site lawfully and not to:
- use the site for any unlawful, fraudulent or harmful purpose
- attempt to circumvent the age verification or any other security feature of the site
- introduce viruses, malware or other harmful code
- scrape, copy or systematically extract content from the site
- use the site to send unsolicited commercial messages
- impersonate any person or misrepresent your identity
- interfere with the operation of the site or with other users' enjoyment of it
We may suspend or terminate your access to the site if we reasonably believe you have breached this clause.
12. Privacy
We process personal data in accordance with our Privacy Policy, which explains what information we collect, how we use it, and your rights under the UK GDPR and the Data Protection Act 2018. By using the site you acknowledge that you have read the Privacy Policy.
13. Our liability to you
We do not exclude or limit our liability to you where it would be unlawful to do so. In particular, we do not exclude or limit liability for:
- death or personal injury caused by our negligence
- fraud or fraudulent misrepresentation
- breach of the statutory rights you have as a consumer in relation to the goods we sell (including the right that goods are of satisfactory quality, fit for purpose and as described)
- any other liability that cannot be excluded or limited under English law
Subject to the above, we are not liable for any loss or damage that was not reasonably foreseeable to both you and us at the time the contract was made, or for any loss or damage caused by events outside our reasonable control.
We are not liable for any business losses. If you use our products for any commercial or business purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
14. Events outside our control
We are not liable for any failure or delay in performing our obligations under these Terms where the failure or delay results from events outside our reasonable control, including but not limited to acts of God, war, civil unrest, strikes, carrier failure, power or network failure, pandemics, or government restrictions. If such an event occurs and substantially affects our ability to deliver your order, we will contact you to discuss options, including refund.
15. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted on the site. If we make a material change that affects your rights, we will give you reasonable notice — for example, by email if you have an account with us, or by a clear notice on the site — before the change takes effect. The Terms in force at the time you place an order will govern that order.
16. Complaints and dispute resolution
If you are unhappy with anything you have bought from us, please email hello@chorusbeer.com in the first instance. We will respond as quickly as we can and aim to resolve the issue within 14 days.
If you are not satisfied with our response and the matter is not resolved, you can seek free, impartial advice from Citizens Advice (citizensadvice.org.uk, or 0808 223 1133), which can refer your complaint to Trading Standards if appropriate. UK consumers may also use the relevant Alternative Dispute Resolution (ADR) bodies; we are happy to provide information on request.
17. General
If any part of these Terms is found to be unlawful or unenforceable, the rest will remain in force.
A failure by us to enforce any provision of these Terms is not a waiver of our right to do so later.
You may not transfer or assign your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations to another business; if we do, we will tell you in writing and your rights under these Terms will not be affected.
These Terms, together with the Privacy Policy and Refund Policy, form the entire agreement between you and us in relation to your use of chorusbeer.com.
18. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
